Welcome to the Utah Bronco Club website (“UBC,” “the Club,” “we,” “us,” or “our”). These Terms & Conditions govern access to and use of the Utah Bronco Club website, including club information, newsletter signup, user accounts, membership dues, and merchandise purchases made through the website or through related in-person ordering options. By using the website, creating an account, signing up for the newsletter, paying dues, or placing an order, the user agrees to these Terms & Conditions.
These Terms & Conditions apply to the Utah Bronco Club website and related club merchandise and membership transactions conducted under the name Utah Bronco Club. Questions regarding these Terms, merchandise orders, dues, or legal notices may be sent to admin@utahbroncoclub.com.
Use of the website, creation of an account, and participation in purchases through the website are limited to individuals who are at least 18 years old. By using the site or placing an order, the user represents that they meet this minimum age requirement.
The website may be used only for lawful purposes and in a manner that does not interfere with the operation, security, or availability of the site. Users may not attempt to gain unauthorized access to any account, server, payment flow, database, or other system connected to the website.
4. Site Content and Club Information
The website provides club information, merchandise sales, membership payment options, and newsletter and shop account functionality. Information on the site may be updated, corrected, suspended, or removed at any time without notice, including information about products, pricing, events, dues, availability, and club benefits.
5. Accounts and Newsletter Signups
User accounts are currently intended for newsletter signup and shop-related use only. Users are responsible for maintaining accurate account information and for restricting access to their own account credentials. The Club may suspend or terminate accounts that appear fraudulent, abusive, or in violation of these Terms.
6. Merchandise and Product Availability
The Club currently offers hoodies and memberships through the website and expects to add shirts and other swag items in the coming weeks. All product listings, descriptions, sizes, pricing, and availability are subject to change at any time without notice. The Club reserves the right to correct errors in product listings, inventory, or pricing before or after an order is submitted.
Certain items, including hoodies, are offered as true pre-orders, meaning orders may be collected before production is completed and fulfillment may occur after the order window closes. Production and delivery timing for pre-order items is estimated only and may change due to vendor delays, production constraints, supply interruptions, or other circumstances outside the Club’s reasonable control.
8. Payment and Order Submission
Payment may be made either online or in person, where applicable. An order is not considered submitted, accepted, or final unless and until payment has been successfully received. If payment is not completed, no order will be placed.
9. Pre-Order Cancellation, Refunds, and Fulfillment Issues
A pre-order may be canceled for a refund until the order is placed into production or otherwise formally submitted by the Club. After that point, the sale is final except in the limited circumstances described in these Terms. If the Club cannot fulfill an order, the available remedy may be, at the customer’s election where reasonably available, a refund, a replacement, or a like-kind substitute item.
At this time, merchandise fulfillment is limited to local handoff in person and the Club does not currently offer shipping. The Club may coordinate in-person delivery, event distribution, or other local handoff arrangements at its discretion. Risk of delay may arise from production timelines, event scheduling, volunteer availability, or other circumstances outside the Club’s reasonable control.
11. Returns, Wrong Items, and Final Sales
All sales are final and the Club does not accept general returns. If a customer receives the wrong item, the customer must notify the Club within 7 days of receipt or handoff. In that circumstance, the Club may review the issue and provide a correction, replacement, refund, or like-kind remedy in its discretion and consistent with product availability.
Membership dues may be paid either online or in person. Membership dues are non-refundable. Payment of dues does not guarantee any fixed or permanent benefit set, and membership benefits, pricing, eligibility, club offerings, or related policies may change at any time in the Club’s discretion.
If a user submits photos, comments, testimonials, messages, or other content to the Club through the website, email, social media, or club channels, the user grants the Club a non-exclusive, royalty-free, worldwide license to use, reproduce, display, publish, distribute, and share that content for club, promotional, editorial, archival, and social media purposes. The user represents that they own the content or have all necessary rights and permissions to submit it.
All website content, including logos, branding, graphics, text, club names, product names, photos, and other materials on the site, is owned by or used with permission by Utah Bronco Club and may not be copied, reproduced, distributed, modified, or commercially used without prior written permission, except for limited personal, non-commercial use allowed by law.
15. Event and Off-Road Activity Disclaimer
The website may reference or promote off-road events, meetups, trail rides, and related club activities. Participation in any such activity is voluntary and undertaken at the participant’s own risk. Off-road driving and related activities involve inherent risks, including vehicle damage, property damage, bodily injury, and death. Each participant is solely responsible for personal safety, passengers, vehicle condition, equipment, insurance, licensing, legal compliance, and conduct during any event or activity.
The website and all content, services, and merchandise offerings are provided on an “as is” and “as available” basis to the fullest extent permitted by law. The Club disclaims all express and implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not guarantee uninterrupted site operation, error-free functionality, or availability at any particular time.
To the fullest extent permitted by Utah law, Utah Bronco Club and its officers, volunteers, members, representatives, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of the website, membership participation, purchases, pre-orders, delays, local handoff arrangements, events, or reliance on site content. For merchandise-related claims, the Club’s total liability shall not exceed the amount actually paid for the applicable order.
The website may rely on or link to third-party tools and services, including ecommerce, email, payment, analytics, social media, and external websites. The Club is not responsible for the content, policies, availability, or practices of third-party services and platforms.
Use of the website is also subject to the Club’s Privacy Policy. Where a separate Privacy Policy is posted, that policy is incorporated by reference into these Terms & Conditions.
These Terms & Conditions are governed by the laws of the State of Utah, without regard to conflict of law principles.
The Club may update these Terms & Conditions at any time by posting a revised version on the website with an updated effective date. Continued use of the website after any update constitutes acceptance of the revised Terms.
